Distance Sales Contract

This Distance Sales Contract ("Contract") is formed between O’merla, referred to as the "Seller" or "Company," and the customer, referred to as the "Buyer" or "Customer." Together, they are known as the "Parties." This contract pertains to the purchase of shoes and related items through distance selling methods.

1. Definitions

Seller: O’merla, the provider of shoes and related merchandise.
Buyer: The individual or entity buying shoes and related items from the Seller.
Goods: Refers to shoes, accessories, and other related items purchased by the Buyer from the Seller via distance selling.
Distance Selling: The sale of goods through electronic means, including online transactions.


2. Scope

This Contract governs all transactions made between the Seller and Buyer using distance selling techniques, specifically for buying shoes and related goods. By ordering, the Buyer consents to the terms laid out in this Contract.

3. Ordering Process

Orders for shoes and related goods can be placed via the Seller's website or other electronic platforms provided by the Seller.
By ordering, the Buyer commits to paying the stated price for the goods, including any taxes, shipping fees, and additional charges.
The Seller has the authority to accept or decline orders at their discretion.


4. Payment

Payments must be completed in full when ordering unless an alternative arrangement is made.
The Seller accepts various payment methods as specified on their website, ensuring secure processing to protect the Buyer’s payment details.


5. Delivery

The Seller aims to deliver goods within the set timeframe, though delivery times can vary.
The Seller is not responsible for delivery delays beyond their control, such as natural disasters or customs delays.


6. Right of Withdrawal

Buyers have the right to withdraw from this Contract within a certain period, according to the distance selling laws of the Buyer’s jurisdiction.
Withdrawal requires written notice within the allowed period, and the Buyer may need to return the goods in their original condition.


7. Warranties and Disclaimers

The Seller guarantees that the goods are free from material and workmanship defects.
All other warranties are disclaimed, including implied warranties of merchantability or fitness for a particular purpose.


8. Limitation of Liability

The Seller is not liable for indirect or consequential damages from the use of the goods.
Liability for claims under this Contract is limited to the amount paid by the Buyer.


9. Governing Law and Jurisdiction

10. Entire Agreement

This Contract is the full agreement between the Parties on distance selling of shoes and related goods, overriding any previous agreements.
